Welcome to Fluxiva. These Terms of Service ("Terms") govern your access to and use of the website located at shopfluxiva.com (formerly tryfluxiva.com) (the "Site") and your purchase of any products sold through it (the "Products"). The Site and Products are operated by Fluxiva LLC, a Wyoming limited liability company ("Fluxiva," "we," "us," or "our"), located in the United States.

By accessing the Site, placing an order, or using our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase our Products.

1. Eligibility

You must be at least 18 years old (or the age of majority in your state) to make a purchase. By placing an order, you represent that you meet this requirement and that all information you provide is accurate and complete. Fluxiva sells and ships Products only to customers located within the United States.

2. About Our Products

Fluxiva sells dietary supplement products intended to support general health and wellness.

Our Products are dietary supplements, not drugs or medical devices. These statements have not been evaluated by the U.S. Food and Drug Administration. Our Products are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Product descriptions, ingredient claims, and any testimonial content are provided for general informational purposes, reflect individual experiences, and are not guaranteed; results vary from person to person.

3. Safe Use, Allergens & Health Disclaimer

Please read all packaging and labeling before use. By purchasing and using our Products, you acknowledge and agree that:

• You will follow the directions and recommended serving size/dosage on the product label and will not exceed the recommended amount.
• You will review the full ingredient list before use. Ingredients (including any botanical or other active ingredients) may cause allergic reactions or sensitivities in some individuals.
• You should consult a physician or qualified healthcare professional before use, particularly if you are pregnant, nursing, taking medication, have a medical condition, or intend to give the Product to a child.
• You will discontinue use immediately and seek medical advice if you experience any adverse reaction.
• Keep out of reach of children. Do not use if the safety seal is broken or missing. Store as directed on the label.

Nothing on the Site constitutes medical advice. The Product is not a substitute for professional medical care, and you should not rely on it to treat any health condition.

4. Orders & Acceptance

All orders are offers to purchase and are subject to our acceptance. We reserve the right to refuse, cancel, or limit any order for any reason, including suspected fraud, errors in pricing or product information, or limits on quantities purchased. If we cancel an order after you have been charged, we will issue a refund for the cancelled items.

5. Pricing & Payment

All prices are listed in U.S. dollars and are subject to change without notice. You are responsible for any applicable sales tax. By submitting an order, you authorize us (or our payment processor) to charge your selected payment method for the total amount, including taxes and shipping.

Billing descriptor: Charges from us will appear on your card or bank statement as "Fluxiva" or "tryfluxiva.com."

We use third-party payment processors and do not store full payment card details ourselves. We are not responsible for errors caused by your bank or card issuer.

6. Membership Subscription & Auto-Renewal

Please read this section carefully — it describes a recurring charge.

When you purchase certain Products at discounted member pricing, you enroll in the Fluxiva digital membership. By enrolling, you acknowledge and agree that:

• Your membership includes a 2-week free trial. After the free trial ends, your payment method will be automatically charged $39.95, and will then renew automatically every 28 days at $39.95 until you cancel.
• The membership is a digital subscription that provides benefits including monthly newsletters, ebooks, and discounted Product pricing.
• The billing amount, billing frequency, free-trial length, and the date of your first charge are clearly disclosed to you before you complete enrollment, and you must affirmatively consent to these terms at checkout.
• You authorize Fluxiva (and its payment processor) to charge your payment method on this recurring basis at the then-current price until you cancel.
• You may cancel at any time with no commitment by emailing support@shopfluxiva.com or using our contact form. To avoid the next charge, cancel before your trial ends or before your next renewal date.
• Cancellation stops future charges. Charges already processed before your cancellation request are non-refundable except as required by applicable law.

7. Shipping & Delivery

We aim to ship orders within 2 business days of purchase; however, processing and delivery times are estimates only and delays can occur (including due to carrier issues, weather, high order volume, or events beyond our control). We are not liable for delivery delays. Title and risk of loss pass to you upon our delivery of the Products to the carrier.

8. Returns & Refunds

We offer a 90-day return policy: you may request a return or refund within 90 days of your purchase date, subject to the conditions in our Refund & Return Policy, which is incorporated into these Terms. Because our Products are consumable dietary supplements, certain conditions may apply to opened or used items for health and safety reasons. 9. Promotions & Discount Codes

Promotional offers, discount codes, and introductory pricing are subject to the specific terms stated at the time of the offer, may be modified or discontinued at any time, cannot be combined unless stated, and have no cash value.

10. Intellectual Property

All content on the Site — including the Fluxiva name, logos, text, graphics, product images, and design — is owned by or licensed to us and is protected by intellectual-property laws. You may not copy, reproduce, or use any of it without our prior written permission.

11. User Content & Reviews

If you submit reviews, photos, comments, or other content, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, and distribute that content in connection with our business. You represent that the content is yours to share and is not unlawful, misleading, or infringing. We may remove any content at our discretion.

12. Prohibited Uses

You agree not to use the Site to: violate any law; infringe others' rights; transmit harmful code; attempt to gain unauthorized access; resell our Products without authorization; scrape or harvest data; or interfere with the Site's operation.

13. Third-Party Links

The Site may contain links to third-party websites or services that we do not control and are not responsible for. Your use of those sites is at your own risk and subject to their terms.

14. Disclaimer of Warranties

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that the Products will meet your expectations.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FLUXIVA AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless Fluxiva and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your misuse of the Products.

17. Dispute Resolution & Arbitration

Please read this section carefully — it affects your legal rights.

Any dispute arising out of or relating to these Terms or the Products will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring qualifying claims in small-claims court.

Class-action waiver: You and Fluxiva agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any class or representative proceeding.

Opt-out: You may opt out of this arbitration agreement within 30 days of your first purchase by sending written notice to support@shopfluxiva.com or through our contact form. If you opt out, neither you nor Fluxiva can require the other to arbitrate.

18. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles, except where the Federal Arbitration Act governs arbitration.

19. Changes to These Terms

We may update these Terms at any time. The "Last updated" date reflects the latest version. Your continued use of the Site or placement of new orders after changes are posted constitutes acceptance of the revised Terms.

20. Severability & Entire Agreement

If any provision is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy, Refund Policy, and any subscription terms, constitute the entire agreement between you and Fluxiva.
